Terms of Service and End User License Agreement (EULA)

1. Intellectual Property and App Restrictions
DetectorVault, including its original code, design, features, map integrations, and AI algorithms, is the exclusive property of Andrew Burnett.
You agree that you will not:
- Copy, duplicate, reproduce, or unlawfully distribute any part of the App.
- Reverse-engineer, decompile, or attempt to extract the source code of the App.
- Use the App to create a competing product or service.
- Scrape, mine, or unlawfully extract data from the App's maps, databases, or social feeds.
2. User Accounts and Security
You are responsible for keeping your account details secure. You must be at least 13 years old to use this App.
3. Social Features, Trips, and Conduct
DetectorVault includes social features allowing you to share finds, comment, and organise detecting trips. By using these features, you agree to:
- Respectful Conduct: Do not harass, abuse, or spam other users in comments or messages.
- Trip Liability: DetectorVault acts only as a platform for users to connect. We do not organise, sponsor, or oversee the physical trips created by users. If you organise, invite others to, or attend a trip, you do so entirely at your own risk. We are not liable for any injury, property damage, trespassing, or disputes that occur during physical meet-ups.
4. AI Identification Tool
The App includes an AI-powered identification feature to help suggest what your finds might be.
- Not Expert Advice: This tool is for informational and entertainment purposes only. It is not a substitute for professional archaeological identification or official legal classification.
- Treasure Act Compliance: A negative or incorrect AI result does not exempt you from your legal obligations under the Treasure Act 1996. If you suspect an item may be Treasure, you must report it to your local Finds Liaison Officer (FLO) or coroner, regardless of what the AI suggests.
5. Map Overlays and Location Accuracy
DetectorVault provides map functionalities and overlays to assist your detecting.
- No Guarantee of Access: Map overlays are for reference only. They do not indicate public right of way, land ownership, or grant you legal permission to detect on that land.
- Your Responsibility: You are solely responsible for ensuring you are not trespassing and have the landowner's explicit permission before turning on your detector.
6. User Content and Privacy
- Your Data: You retain ownership of your photos, find data, and comments. By posting them publicly within the App's social section, you grant us a non-exclusive, royalty-free, worldwide licence to display them to other users of the App.
- Location Privacy: You control the visibility of your finds. Be cautious when publicly sharing precise locations or GPS coordinates in the social feed to protect your permissions and the integrity of the land.

7. Legal Compliance
You agree to use the App responsibly and abide by all UK laws. You represent and warrant that you will not use the App to log, share, or map illegally obtained items, and that you will not detect on Scheduled Monuments without written consent.
8. Limitation of Liability
To the fullest extent permitted by law, DetectorVault is provided "as is." We are not liable for lost data, app downtime, legal penalties, confiscated finds, or any damages arising from your use of the App, the AI tool, the maps, or the social features.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under English law. Nothing in these Terms affects your statutory rights as a consumer.
9. Your Indemnity to Us
You agree to indemnify and hold harmless DetectorVault and Andrew Burnett against any claims, losses, or legal costs arising from: your breach of these Terms; your use of the App in violation of UK law (including trespass, illegal night-hawking, or detecting on Scheduled Monuments without consent); or any dispute between you and another user (including disputes arising from physical meet-ups organised through the App).
10. Account Termination
We reserve the right to suspend or terminate your account without notice if you violate these Terms (e.g. stealing our code, harassing users, or promoting illegal night-hawking).
11. Changes to These Terms
We may update these Terms from time to time. When we do, you will be asked to read and accept the updated version on your next visit before continuing to use the App. Your continued use of the App after acceptance constitutes agreement to the new Terms.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms (together with the Privacy Policy) constitute the entire agreement between you and us regarding the App. Our failure to enforce any right or provision is not a waiver of that right or provision.
